CALIFORNIA LEGISLATURE— 2021–2022 REGULAR SESSION

Assembly Bill
No. 1109

Introduced by Assembly Member Gabriel

February 18, 2021

An act to amend Section 1559 of the Civil Code, relating to contracts.

LEGISLATIVE COUNSEL'S DIGEST

AB 1109, as introduced, Gabriel. Contracts: parties.
Existing law requires contracts to have, among other things, parties capable of contracting. Existing law provides that if a contract is made expressly for the benefit of a 3rd person, the contract may be enforced by that 3rd person before the parties to the contract rescind it.
This bill would make a nonsubstantive change to those provisions.

The people of the State of California do enact as follows:

Section 1559 of the Civil Code is amended to read:

1559.
