(a) For purposes of this section, the following definitions apply:(1) “Commission” means the State Energy Resources Conservation and Development Commission.
(2) “Electric vehicle charging station” means an electric vehicle charging station that is under state control or
operation. installed on or after January 1, 2024, that received an incentive from a state agency or through a charge on ratepayers.
(b) (1) The commission, beginning January 1, 2025, shall biennially conduct a study on electric vehicle charging stations that reports information and recommendations on electric vehicle charging stations, and the commission shall incorporate the information and recommendations into the updates of the statewide assessment of electric vehicle charging infrastructure required pursuant to Section 25229 of the Public Resources Code. The study
shall adhere to the following criteria: assess, in consultation with applicable state agencies, including, but not limited to, the Department of General Services and the California Building Standards Commission, and applicable federal agencies, including, but not limited to, the federal Access Board, the abidance of electric vehicle charging stations with electric vehicle charging station-related accessibility requirements, including, but not limited to, the California Building Standards Code (Title 24 of the California Code of Regulations) and related guidance of the California Building Standards Commission, and other guidance from relevant state and federal agencies, including guidance issued after the effective date of this chapter.
(A)The study shall include an analysis of architectural, design, or programmatic barriers that people with mobility, sensory, or other types of disabilities may encounter when trying to access an electric vehicle charging station and recommendations, including legislative recommendations, on how to remove barriers or prevent barriers from occurring.
(B)The study shall include, after the commission has worked with applicable state agencies, including, but not limited to, the Department of Transportation, the Department of General Services, and the California Building Standards Commission, any applicable regulations and
information on how the report’s recommendations, if any, conflict with or would impact those regulations.
(C)The study shall include information on whether electric vehicle charging stations have a feature to call or prompt an attendant to assist the customer with the operation of the electric vehicle charging station equipment and whether electric vehicle charging stations have attendants present to provide assistance.
(2) The biennial study assessment shall include a biennial report that shall
be submitted to the Legislature concurrently with the commission’s incorporation of the information and recommendations into the updates of the statewide assessment of the electric vehicle charging infrastructure.
(c) (1) The commission shall submit the report required by subdivision (b) in compliance with Section 9795 of the Government Code.
(2) Pursuant to Section 10231.5 of the Government Code, this
chapter shall be repealed on January 1, 2036.
