CALIFORNIA LEGISLATURE— 2019–2020 REGULAR SESSION

Assembly Bill
No. 1589

Introduced by Assembly Member Salas

February 22, 2019

An act to amend Section 44280 44282.5 of the Health and Safety Code, relating to vehicular air pollution.

LEGISLATIVE COUNSEL'S DIGEST

AB 1589, as amended, Salas. Carl Moyer Memorial Air Quality Standards Attainment Program. Program: heavy-duty off-road equipment.
Existing law establishes the Carl Moyer Memorial Air Quality Standards Attainment Program, which is administered by the State Air Resources Board. The program authorizes the state board to provide grants to offset the incremental cost of eligible projects that reduce emissions from covered vehicular sources. The program also authorizes funding for a fueling infrastructure demonstration program and for technology development efforts that are expected to result in commercially available technologies in the near-term that would improve the ability of the program to achieve its goals. The state board is required to establish and update grant criteria and guidelines for covered vehicle projects. The program deems an off-road project that involves farm equipment to have a minimum project life of at least 10 years, as specified.

This bill would make technical, nonsubstantive changes to these provisions.

This bill would additionally authorize as an eligible project under the program equipment powered by a diesel engine certified to the cleanest available emission level to replace the baseline equipment for a heavy-duty off-road equipment replacement project that involves farm equipment and the baseline equipment is powered by an uncontrolled gasoline engine, as specified.

The people of the State of California do enact as follows:

(c) (1) Notwithstanding any other law, the baseline equipment for a heavy-duty off-road equipment replacement project that involves farm equipment and the baseline equipment is powered by an uncontrolled gasoline engine may be replaced by equipment powered by a diesel engine certified to the cleanest available emission level.
(2) Eligible projects pursuant to this subdivision shall meet the cost-effectiveness per ton of NOx reduced required pursuant to Section 44283.

SECTION 1.Section 44280 of the Health and Safety Code, as amended by Section 17 of Chapter 401 of the Statutes of 2013, is amended to read:
