An act to amend Section 19605.52 of, and to add Section 19424.6 to, of the Business and Professions Code, relating to horse racing.

California Horse Racing Board: fair board members: satellite Satellite wagering: Kern County: Shasta County.
The Horse Racing Law establishes the California Horse Racing Board and provides for the operation of live horse racing in this state and for wagering thereon, and for the operation of satellite wagering facilities, subject to regulation and oversight by the board.
This bill would provide that, in order to permit the full participation of fair board members who may be appointed to the California Horse Racing Board, the Legislature declares that the appointment of fair board members is intended to represent and further the interests of California’s fair network, and that representation and furtherance will ultimately serve the public interest.
The Horse Racing Law authorizes any fair in Kern or Shasta County, with the approval of the Department of Food and Agriculture and the authorization of the board, California Horse Racing Board, to operate one satellite wagering facility within the boundaries of the fair, under certain conditions.
This bill would provide that a satellite wagering facility authorized pursuant to these provisions may be operated by an agreement between the fair and a specified entity.

The people of the State of California do enact as follows:
SECTION 1.Section 19424.6 is added to the Business and Professions Code, to read:19424.6.In order to permit the full participation of fair board members who may be appointed to the California Horse Racing Board, the Legislature declares that the appointment of fair board members is intended to represent and further the interests of California’s fair network, and that representation and furtherance will ultimately serve the public interest.
SEC. 2.SECTION 1.
Section 19605.52 of the Business and Professions Code is amended to read:19605.52.
(a) Notwithstanding subdivision (a) of Section 19605, and Section 19605.1, any fair in Kern or Shasta County may, with the approval of the Department of Food and Agriculture and the authorization of the board, subject to the conditions specified in Section 19605.3, operate one satellite wagering facility within the boundaries of that fair.(b) A satellite wagering facility authorized pursuant to subdivision (a) may be operated by an agreement between the fair and an entity described in Section 19604, pursuant to the provisions of that section.
