An act to amend Section 60043 of the Education Code, relating to educational materials, and making an appropriation therefor.

Educational materials: labor history.
(1) Existing law requires the governing board of a school district, in adopting instructional materials, to require that textbooks for social science, history, or civics include the Declaration of Independence and the Constitution of the United States.
This bill would, in addition, require the governing board of a school district to require that textbooks for those subjects to include material that relates to California labor history, as specified, thus imposing a state-mandated local program.
(2) The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement, including the creation of a State Mandates Claims Fund to pay the costs of mandates that do not exceed $1,000,000 statewide and other procedures for claims whose statewide costs exceed $1,000,000.
This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions.
Existing law requires the State Board of Education to adopt statewide academically rigorous content standards, including those for the core curriculum areas of history and social science.
This bill would appropriate $100,000 in order to provide sufficient funding to the Superintendent of Public Instruction for allocation to school districts in order to enable school districts to purchase instructional materials that relate to those content standards in history and social sciences and that pertain to California labor history.

The people of the State of California do enact as follows:
SECTION 1.The sum of one hundred thousand dollars
Section 60043 of the Education Code is amended to read:
60043.
When In adopting instructional materials for use in the schools, the governing board shall require, when appropriate to the comprehension of pupils, that textbooks for social science, history, or civics classes contain the Declaration of Independence and the Constitution of the United States.(b) In adopting instructional materials for use in the schools, the governing board shall require that textbooks for social science, history, or civics classes contain material that relate to California labor history and trace the advances and retreats of organized labor, from the creation of the American Federation of Labor and the Congress of Industrial Organizations to current issues of a postindustrial, multinational economy, including the United Farm Workers in California, to be used during Labor History Week and other appropriate occasions.
SEC. 2.
Notwithstanding Section 17610 of the Government Code, if the Commission on State Mandates determines that this act contains costs mandated by the state, reimbursement to local agencies and school districts for those costs shall be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of the Government Code. If the statewide cost of the claim for reimbursement does not exceed one million dollars ($1,000,000), reimbursement shall be made from the State Mandates Claims Fund.($100,000) is hereby appropriated from the General Fund to the Superintendent of Public Instruction for allocation to school districts in order to enable school districts to purchase textbooks, curricula, lesson plans, and other appropriate instructional materials, that are consistent with the history and social sciences standards adopted pursuant to subdivision (a) of Section 60605 of the Education Code and that relate to California labor history, from the Spanish colonial period to the present day, so that they may be used during Labor History Week.
