An act to add Section 743.2 to the Public Utilities Code, relating to public utilities.

AB 12, as introduced, Rod Pacheco. Public utilities: involuntary blackouts.
Existing law requires the creation and operation of an Independent System Operator to ensure efficient use and reliable operation of the state’s electricity transmission grid consistent with achievement of specified planning and operating reserve criteria.
This bill would exempt public or private schools, public or private postsecondary educational institutions, providers of essential medical services, jails and prisons, and law enforcement facilities from involuntary service interruptions during any state of emergency declared by the Independent Service Operator.

The people of the State of California do enact as follows:


SECTION 1.

 Section 743.2 is added to the Public Utilities Code, to read:

743.2.
 The following entities shall be exempt from involuntary service interruptions during any state of emergency declared by the Independent Service Operator:
(a) Public or private schools for pupils in kindergarten or grades 1 to 12, inclusive.
(b) Public or private postsecondary educational institutions.
(c) Providers of essential medical services, such as, but not limited to, blood banks, general acute care hospitals, and nursing homes.
(d) Jails and prisons.
(e) Law enforcement facilities.
