An act to amend Section 11780 of the Government Code, relating to information technology. An act relating to community colleges, making an appropriation therefor, and declaring the urgency thereof, to take effect immediately.

Information technology: community Community colleges: funding.
The Budget Bill for the 2001–02 fiscal year, as passed by the Legislature, appropriated funds for scheduled maintenance, special repairs, instructional equipment, and library materials replacement for the California Community Colleges. When the Governor approved this bill, which became the Budget Act of 2001, he deleted these funds, among others.
This bill would enact the Community College Budget Restoration Act of 2001. The bill would appropriate $98,000,000 from the General Fund to the Board of Governors of the California Community Colleges in augmentation of a specified item of the Budget Act of 2001, $49,000,000 of which would be allocated for scheduled maintenance and special repairs, and $49,000,000 of which would be allocated for instructional equipment and library materials replacement.
The funds appropriated by this bill would be applied toward the minimum funding requirements for school districts and community college districts imposed by Section 8 of Article XVI of the California Constitution.
The bill would declare that it is to take effect immediately as an urgency statute.
Existing law establishes the Department of Information Technology for the purpose of developing and coordinating information technology activities in the state and providing guidance and oversight to state agencies regarding information technology. Existing law also provides that these provisions do not apply to specified state agencies.
This bill would provide that these provisions also do not apply to the Board of Governors of the California Community Colleges nor to the California Postsecondary Education Commission. The bill would require the Board of Governors of the California Community Colleges and the California Postsecondary Education Commission to observe standard project management methodologies and principles for information technology projects as published by the Department of Information Technology and report to the Governor, the Director of the Department of Information Technology, and the Legislature on their information technology projects and on the demonstrable application of those standard project management methodologies and principles, on an annual basis, as specified.

The people of the State of California do enact as follows:
SECTION 1.Section 11780 of the Government Code is
SECTION 1.
This act shall be known, and may be cited, as the Community College Budget Restoration Act of 2001.SEC. 2.
The sum of ninety-eight million dollars ($98,000,000) is hereby appropriated from the General Fund to the Board of Governors of the California Community Colleges, in augmentation of Item 6870-101-0001 of Section 2.00 of the Budget Act of 2001, for allocation in the 2001–02 fiscal year as follows:(a) Forty-nine million dollars ($49,000,000) for scheduled maintenance and special repairs.
(b) Forty-nine million dollars ($49,000,000) for instructional equipment and library materials replacement.
SEC. 3.
This act is an urgency statute necessary for the immediate preservation of the public peace, health, or safety within the meaning of Article IV of the Constitution and shall go into immediate effect. The facts constituting the necessity are:In order to address the urgent funding needs of the California Community Colleges for the 2001–02 academic year, it is necessary that this act take effect immediately.

11780.(a)The provisions of this chapter do not apply to the University of California, the California State University, the Board of Governors of the California Community Colleges, the California Postsecondary Education Commission, the State Compensation Insurance Fund, the community college districts, agencies provided for by Article VI of the California Constitution, or the Legislature.
(b)Notwithstanding subdivision (a), in order to promote efficiency in state government, the Board of Governors of the California Community Colleges and the California Postsecondary Education Commission shall observe standard project management methodologies and principles for information technology projects as published by the Department of Information Technology and shall each report, on an annual basis, to the Governor, the Director of the Department of Information Technology, and the Legislature on their information technology projects and on the demonstrable application of those standard project management methodologies and principles. The reports shall be separate from the annual reports required from the Board of Governors of the California Community Colleges and the California Postsecondary Education Commission, but shall be delivered on the same day that the annual reports are due.
