An act to add Section 43022.6 to the Health and Safety Code, relating to vehicular air pollution.

AB 1594, as amended, Bauer-Kahan. Heavy-duty Onroad heavy-duty vehicles: electric vehicle charging stations: ports.
The California Global Warming Solutions Act of 2006 designates the State Air Resources Board as the state agency charged with monitoring and regulating sources of emissions of greenhouse gases. The act authorizes the state board to include the use of market-based compliance mechanisms. Existing law requires all moneys, except for fines and penalties, collected by the state board as part of a market-based compliance mechanism to be deposited in the Greenhouse Gas Reduction Fund and to be available upon appropriation by the Legislature.
The California Clean Truck, Bus, and Off-Road Vehicle and Equipment Technology Program, upon appropriation from the Greenhouse Gas Reduction Fund, funds zero- and near-zero-emission truck, bus, and off-road vehicle and equipment technologies and related projects.
This bill, by no later than January 1, 2030, would require the state board to implement an incentive program to ensure at least 2 electric vehicle charging stations for are available at any given time during regular port hours to onroad heavy-duty vehicles are installed at each of the Ports of Long Beach, Los Angeles, and Oakland, as specified.

The people of the State of California do enact as follows:


SECTION 1.

 Section 43022.6 is added to the Health and Safety Code, to read:

43022.6.
 (a) No later than January 1, 2030, the state board shall implement an incentive program to ensure at least two electric vehicle charging stations for are available at any given time during regular port hours to onroad heavy-duty vehicles are installed at each of the following ports:
(1) Port of Long Beach.
(2) Port of Los Angeles.
(3) Port of Oakland.
(b) Moneys from the General Fund shall be available, upon appropriation by the Legislature in the annual Budget Act or other enacted statute, to the state board following the adoption of guidelines to implement this section.
