An act to add Section 7.95 to the Government Code, relating to the State Race Track Leasing Commission.

SB 1321, Kehoe. State Race Track Leasing Commission: Director of General Services: powers and duties.
Existing law provides that the State Race Track Leasing Commission is required to prepare a master plan for the long-range comprehensive development and improvement of, and construction upon, the property of the 22nd District Agricultural Association, and specifies other powers and duties of the commission regarding the 22nd District Agricultural Association, as provided.
Existing law provides that whenever a power is granted to, or a duty is imposed upon, the Controller, Treasurer, Director of Finance, or Superintendent of Public Instruction on any state board, commission, committee, or governing board, the power may be exercised or the duty may be performed by a deputy designated by the officer to act in his or her place and stead, unless otherwise expressly provided.
This bill would specifically authorize the Director of General Services and the Secretary of Food and Agriculture to each designate a deputy of his or her office to act in his or her place and stead on the State Race Track Leasing Commission with respect to the exercise of the statutory powers and duties of the commission.

The people of the State of California do enact as follows:


SECTION 1.

 Section 7.95 is added to the Government Code, to read:

7.95.
 Notwithstanding any provision of law, the Director of General Services and the Secretary of Food and Agriculture may each designate any deputy of his or her office to act in his or her place and stead on the State Race Track Leasing Commission with respect to the exercise of statutory powers and duties of the commission. The deputy, while sitting on the State Race Track Leasing Commission, may exercise the same powers as the Director of General Services or the Secretary of Food and Agriculture could exercise as if he or she were personally present. The Director of General Services or the Secretary of Food and Agriculture so designating a deputy shall be responsible for the acts of the deputy acting under the designation in the same manner and to the same extent that the Director of General Services or the Secretary of Food and Agriculture is responsible for the acts of the deputy performing his or her official duties as deputy to the Director of General Services or the Secretary of Food and Agriculture.
