An act to amend Section 22234 of the Water Code, relating to water.


LEGISLATIVE COUNSEL'S DIGEST


SB 1844, as introduced, Aanestad. Irrigation districts: ditches and laterals.
Existing law, the Irrigation District Law, authorizes an irrigation district to contract to operate, maintain, or improve ditches and laterals not owned by the district upon the authorization of at least2/3 of the landowners served by those ditches or laterals.
This bill, subject to that authorization, would authorize an irrigation district to construct those ditches or laterals.

The people of the State of California do enact as follows:


SECTION 1.

 Section 22234 of the Water Code is amended to read:

22234.
 (a) A district may contract to operate, maintain, or improve, or construct ditches and or laterals not owned by the district upon petition of at least two-thirds of the owners of land served by such those ditches or laterals.

In

(b) In order to carry out the purposes of this section, a district may make such enter into contracts as that the board deems necessary, including, but not limited to, loan and repayment contracts, construction contracts, and rental of equipment contracts.

The

(c) The amendment of this section made at the 1963 Regular Session of the Legislature by Chapter 524 of the Statutes of 1963 does not constitute a change in, but is declaratory of, the pre-existing law.
