An act relating to fish, making an appropriation therefor, and declaring the urgency thereof, to take effect immediately.

SB 1311, Chesbro. Salmon and steelhead trout habitat.
The Budget Act of 1999 prohibits the expenditure of federal funds available from the Pacific Coastal Salmon Recovery Account administered by the National Marine Fisheries Service or from any other source for the Watershed and Salmon Restoration Strategy Program that are not appropriated in that act unless and until a statute is enacted authorizing and defining that program and specifying the use of the federal funds.
This bill would appropriate $9,000,000 in federal funds from the Pacific Coastal Salmon Recovery Fund to the Department of Fish and Game for the protection and recovery of salmon and steelhead trout pursuant to a specified Memorandum of Understanding between the Department of Fish and Game, the Resources Agency, and the United States Department of Commerce, National Marine Fisheries Service. The bill would make a legislative finding that this provision satisfies the requirements of the Budget Act of 1999, as specified.
This bill would also declare that it is to take effect immediately as an urgency statute.
Appropriation: YES  

The people of the State of California do enact as follows:


SECTION 1.

 (a) The sum of nine million dollars ($9,000,000) in federal funds from the Pacific Coastal Salmon Recovery Fund is hereby appropriated to the Department of Fish and Game for the protection and recovery of salmon and steelhead trout pursuant to the Memorandum of Understanding between the Department of Fish and Game, the Resources Agency, and the United States Department of Commerce, National Marine Fisheries Service, dated May 5, 2000, regarding administration of the Pacific Coastal Salmon Recovery Fund.
(b) The Legislature finds and declares that the enactment of this section satisfies the requirements of Provision 1 of Item 0540-001-0001 of Section 2.00 of the Budget Act of 1999 and nothing in that provision shall be construed to prevent the expenditure of funds appropriated by this section.

SEC. 2.

 This act is an urgency statute necessary for the immediate preservation of the public peace, health, or safety within the meaning of Article IV of the Constitution and shall go into immediate effect. The facts constituting the necessity are:
In order to commence the work relating to the protection and recovery of salmon and steelhead trout at the earliest possible time, it is necessary that this act take effect immediately.
