To the Members of the California State Assembly: I am returning Assembly Bill 1138 without my signature. This bill creates a new misdemeanor for the false or misleading advertising related to the sale of dogs and cats. Existing law already makes it unlawful to make fraudulent, deceptive, untrue, or misleading advertisements. A violation of existing law is a misdemeanor punishable by imprisonment in county jail not exceeding six months, or by a fine not exceeding $2,500, or both.
