An act to add Section 1122.6 to the Fish and Game Code, relating to fish.

SB 1009, Dahle. Mount Shasta Fish Hatchery: lease.
Existing law requires the Fish and Game Commission to establish fish hatcheries for the purposes of stocking the waters of California with fish, and requires the Department of Fish and Wildlife to maintain and operate those hatcheries.
This bill would authorize the Director of General Services, with the consent of the Department of Fish and Wildlife, to lease at no cost a portion of the Mount Shasta Fish Hatchery to the Mt. Shasta Museum Association for a term not to exceed 25 years, and with the possibility of renewal. The bill would require the leased property to be utilized for specified educational purposes. This bill would also require the lease to contain provisions that do all of the following: (1) require the Mt. Shasta Museum Association to permit reasonable public access to the facility, to obtain and maintain liability insurance for the leased portion of the facilities, and to maintain the leased building at all times; and (2) require that the state, the department, and agents of the state and the department be held harmless from, and indemnified against, any liability resulting from the acts or omissions of the lessee performed in the course of the lease agreement.
This bill would make legislative findings and declarations as to the necessity of a special statute for the Mount Shasta Fish Hatchery.

The people of the State of California do enact as follows:


SECTION 1.

 The Legislature finds and declares that the operation of Building A and the storage building constructed for use by the lessee of Building A of the Mount Shasta Fish Hatchery as a historical museum and for educational purposes will serve a statewide public purpose.

SEC. 2.

 Section 1122.6 is added to the Fish and Game Code, to read:

1122.6.
 (a) The Director of General Services, with the consent of the department, may lease to the Mt. Shasta Museum Association at no cost, and subject to any other terms and conditions that the director deems appropriate, for a term not to exceed 25 years, and with the possibility of renewal, a portion of the Mount Shasta Fish Hatchery, a building commonly known as Building A and the storage building constructed for use by the lessee of Building A, situated in the County of Siskiyou.
(b) The leased property shall be used only for the operation of a historical museum and for environmental educational purposes.
(c) The lease shall require the Mt. Shasta Museum Association to permit reasonable public access to the building, to obtain and maintain liability insurance for the leased building, and to maintain the leased building at all times.
(d) The lease shall also provide that the state, agents of the state, the department, and agents of the department shall be held harmless from, and indemnified against, any liability resulting from the acts or omissions of the Mt. Shasta Museum Association performed in the course of the lease agreement.

SEC. 3.

 The Legislature finds and declares that a special statute is necessary and that a general statute cannot be made applicable within the meaning of Section 16 of Article IV of the California Constitution because of the unique needs of the community and the unique nature of the Mount Shasta Fish Hatchery.
