An act to amend add Section 350 of 358.5 to the Family Code, relating to marriage.

AB 2789, as amended, Wallis. Marriage: license requirements. change of name.
Existing law requires the State Department of Public Health to prepare and publish a brochure containing specified information for distribution to applicants for marriage licenses and persons who qualify as domestic partners that includes, among other things, information concerning options for changing a name upon solemnization of marriage.
This bill would require the State Department of Public Health to create and maintain an internet website that contains instructional information regarding how a person can change their name after they get married and a list of all agencies that need to be notified of a name change that occurs after a marriage.

Existing law requires the parties, before entering a marriage or declaring a marriage, as specified, to first obtain a marriage license from the county clerk. Existing law requires the attorney-in-fact to appear before the county clerk to obtain a marriage license on behalf of the party who is a member of the Armed Forces of the United States who is stationed overseas and serving in a conflict of war and is unable to appear for the licensure and solemnization of the marriage.

This bill would make a technical, nonsubstantive change to this provision.

The people of the State of California do enact as follows:


SECTION 1.

 Section 358.5 is added to the Family Code, to read:

358.5.
 The State Department of Public Health shall create and maintain an internet website that contains both of the following:
(a) Instructional information regarding how a person can change their name after they get married.
(b) A list of all agencies that need to be notified of a name change described in subdivision (a).

SECTION 1.Section 350 of the Family Code is amended to read:
350.

(a)Before entering a marriage, or declaring a marriage pursuant to Section 425, the parties shall first obtain a marriage license from a county clerk.

(b)If a marriage is to be entered into pursuant to subdivision (b) of Section 420, the attorney-in-fact shall appear before the county clerk as prescribed in subdivision (a) on behalf of the party who is overseas.
