LEGISLATIVE COUNSEL'S DIGEST
AB 2611, as introduced, Wallis.
Political Reform Act of 1974: conflicts of interest.
Existing provisions of the Political Reform Act of 1974 prohibit a public official from making, participating in making, or attempting to use their official position to influence a governmental decision in which they know or have reason to know that they have a financial interest, as defined. However, existing law permits a public official to make or participate in the making of a governmental decision, even if the public official knows or has reason to know that the official has a financial interest, if the official’s participation is legally required for the action or decision to be made.
This bill would make a technical, nonsubstantive change to the provision containing that exception.

Bill Text
The people of the State of California do enact as follows:
SECTION 1.
Section 87101 of the Government Code is amended to read:87101.
Section 87100 does not prevent any a public official from making or participating in the making of a governmental decision to the extent the official’s participation is legally required for the action or decision to be made. The fact that an official’s vote is needed to break a tie does not make the official’s participation legally required for purposes of this section.
