An act to amend Section 396 of the Vehicle Code, relating to mobile coaches. mobilehomes.

AB 22, as amended, Gipson. Mobilehomes: mobile coaches. Mobilehomes.
Existing law defines “mobilehome” for purposes of the enforcement of highway safety laws and regulations as a trailer coach which is in excess of 102 inches in width or in excess of 40 feet in overall length measured from the foremost point of the trailer hitch to the rear extremity of the trailer.
This bill would increase the width in the above-specified definition from 102 inches to 110 inches.

Existing law, the Mobilehome Residency Law, governs the term and conditions of mobilehome park tenancies, including rental agreements between homeowners and the management of the mobilehome park and park rules and regulations. Existing law, the Mobilehome Parks Act, establishes requirements for the construction, maintenance, occupancy, use, and design of mobilehome parks. Existing law, the Recreational Vehicle Park Occupancy Law, governs the terms and conditions of recreational vehicle park tenancies.

This bill would express the intent of the Legislature to enact legislation that would classify motor coaches that are parked in a mobilehome park for a period of time that satisfies residency requirements as mobilehome properties to give mobile coach owners the ability to build home equity. The bill would state findings and declarations in that regard.

The people of the State of California do enact as follows:


SECTION 1.

 Section 396 of the Vehicle Code is amended to read:

396.
 “Mobilehome” is a structure as defined in Section 18008 of the Health and Safety Code. For the purposes of enforcement of highway safety laws and regulations, a mobilehome is a trailer coach which that is in excess of 102 110 inches in width, width or in excess of 40 feet in overall length measured from the foremost point of the trailer hitch to the rear extremity of the trailer.

SECTION 1.

(a)The Legislature finds and declares both of the following:

(1)The owners of motor coaches used as permanent residences who reside in mobilehome parks are unable to accrue home equity and are not afforded the benefits mobilehome owners are afforded, thus creating inequity and preventing motor coach owners from building generational wealth that comes from owning other types of housing.

(2)Despite being permanent residences for seniors and other low-income populations, motor coaches are classified as vehicles and therefore depreciate over time.

(b)It is the intent of the Legislature to enact legislation that would classify motor coaches that are parked in a mobilehome park for a period of time that satisfies residency requirements as mobilehome properties to give mobile coach owners the ability to build home equity.
