An act to add Section 129853 to the Health and Safety Code, relating to health facilities, and making an appropriation therefor.

SB 563, Galgiani. Office of Statewide Health Planning and Development: hospital construction.
Existing law requires the Office of Statewide Health Planning and Development to pass upon and approve or reject all plans for the construction or the alteration of any hospital building, as specified. Existing law requires the office to determine and establish an application filing fee that will cover the costs of administering these requirements, and requires the deposit of these fees into the Hospital Building Fund, which is continuously appropriated for the use of the office in carrying out these provisions.
This bill would require a person or entity requesting a copy of construction documents maintained by the office to bear the cost of producing the copy of those documents. The bill would require the office to provide an estimate of those costs to the requester before beginning to make those copies. To the extent that this requirement would increase the costs of administering the above-described requirements and amounts of moneys from fees deposited into the Hospital Building Fund, this bill would make an appropriation.

The people of the State of California do enact as follows:


SECTION 1.

 Section 129853 is added to the Health and Safety Code, to read:

129853.
 (a) The person or entity requesting a copy of construction documents maintained by the office shall bear the actual cost of producing the copy of those documents, including staff time spent retrieving, inspecting, and handling the documents, copying costs, and shipping costs.
(b) The office shall provide an estimate of the costs described in subdivision (a) to the requester before the office begins to make those copies.
