An act to amend Section Sections 18745 and 18766 of, and to add Section 18766.5 to, the Education Code, relating to libraries.

SB 331, as amended, Liu. California Library Services Act: statewide communications and delivery intranet. collaborative network.
The California Library Services Act establishes the California Library Services Board and provides that its duties include, among other things, adopting rules, regulations, and general policies relating to the implementation of the act. The act provides for the establishment of systems, which are defined as cooperative library systems. The act requires the California Library Services Board to establish and administer 2 or more state reference centers to be responsible for answering reference requests that cannot be met by systems and libraries participating in the programs authorized by the act.
Existing law and requires the California Library Services Board board to, among other things, establish and maintain a statewide communications and delivery network between and among cooperative library systems, state reference centers, independent public libraries, and all other libraries participating in the programs authorized by the act.
This bill would instead require the California Library Services Board board to establish and maintain a statewide communications and delivery intranet, rather than network, which may also be accessed by public elementary, secondary, and postsecondary schools collaborative network between cooperative library systems, independent public libraries, and all other libraries participating in the programs authorized by the act. The bill would also authorize the State Librarian, with approval of the board, to enter into a cooperative agreement with a high-bandwidth, high-capacity Internet service provider for the purpose of providing services to all public libraries in the state, as provided.
Existing law requires each cooperative library system, as defined, to annually apply for funds for intrasystem communications and delivery, and requires the proposals to be based upon the most cost-effective methods of exchanging materials and information among member libraries.
This bill would specify that applications to the board for funds for intrasystem communications and delivery may include, requests for grant assistance for broadband capacity upgrades. The bill would also require that proposals be based on the most cost-effective methods for information and resource sharing, including electronic or physical delivery.

The people of the State of California do enact as follows:


SECTION 1.

 Section 18745 of the Education Code is amended to read:

18745.
 Each system shall annually apply to the state board for funds for intrasystem communications and delivery, which may include, but is not limited to, requests for grant assistance for broadband capacity upgrades, to the extent funds are available. Proposals shall be based upon the most cost-effective methods of exchanging materials and information among the member libraries for information and resource sharing, including, but not limited to, electronic or physical delivery.

SECTION 1.SEC. 2.

 Section 18766 of the Education Code is amended to read:

18766.
 The state board shall establish and maintain a statewide communications and delivery intranet between and among systems; public elementary, secondary, and postsecondary schools; state reference centers; independent public libraries; collaborative network between cooperative library systems, independent public libraries, and all other libraries participating in the programs authorized by this act.

SEC. 3.

 Section 18766.5 is added to the Education Code, to read:

18766.5.
 (a) The State Librarian, with approval of the state board, may enter into a cooperative agreement with a high-bandwidth, high-capacity Internet service provider for the purpose of providing services to all public libraries in the state, including the most underserved.
(b) The state board shall develop formulas for the equitable allocation of reimbursements or grant distributions to systems, pursuant to subdivision (f) of Section 18724, for any dedicated state funding associated with a system’s participation in the statewide communications and delivery collaborative network and related costs pertaining to broadband capacity upgrades.
