An act to add Chapter 10 (commencing with Section 100650) to Part 12 of Division 10 of the Public Utilities Code, relating to transportation.

AB 1046, as amended, Gordon. Department of Transportation: Innovative Delivery Team Demonstration Program.
Existing law provides that the Department of Transportation has full possession and control of the state highway system. Existing law creates the Santa Clara Valley Transportation Authority with various transportation responsibilities in the County of Santa Clara.
This bill would state the intent of the Legislature to enact legislation that would facilitate the implementation of the master agreement executed by the Department of Transportation and the Santa Clara Valley Transportation Authority for the Innovative Delivery Team Demonstration Program in order to improve project delivery, traffic operations analysis, and local assistance services in the County of Santa Clara authorize the department’s District 4 director to direct existing District 4 resources to the Innovative Delivery Team Demonstration Program and to authorize department staff to perform reimbursed work for projects on and off the state highway system within the boundaries of the County of Santa Clara pursuant to the master agreement, as defined, and accompanying work programs, as defined.

The people of the State of California do enact as follows:


SECTION 1.

 The Legislature hereby finds and declares all of the following:
(a) Delivering high-quality transportation projects in the County of Santa Clara on time and on budget is a priority for the Department of Transportation and the Santa Clara Valley Transportation Authority. Along these lines, the department and the authority have agreed to implement an Innovative Delivery Team Demonstration Program that envisions taking the partnership between the two organizations to the highest level possible. The goal of this demonstration program is to try out different and innovative approaches for how the department and the authority can work better as a team for the purpose of improving project delivery, traffic operations analysis, and local assistance services.
(b) By serving as a testing laboratory for trying out different and innovative approaches, the demonstration program presents an excellent opportunity for challenging the status quo, engaging in outside-the-box thinking, and taking significant steps to improve project delivery, traffic operations analysis, and local assistance services. For those ideas that prove successful, the department could then determine whether they can be applied to other parts of the state.
(c) The intent of the Legislature in enacting this act is to facilitate the implementation of the master agreement executed by the department and the authority for the Innovative Delivery Team Demonstration Program, as well as the accompanying work plans for the three areas of project delivery, traffic operations analysis, and local assistance services.

SEC. 2.

 Chapter 10 (commencing with Section 100650) is added to Part 12 of Division 10 of the Public Utilities Code, to read:
CHAPTER  10. Innovative Delivery Team Demonstration Program

 For purposes of this chapter, the following shall apply:
(a) “Department” means the Department of Transportation.
(b) “Demonstration program” means the Innovative Delivery Team Demonstration Program.
(c) “Master agreement” means the document for the demonstration program that records the agreement between the department and the Santa Clara County Transportation Authority to collaborate on improving project delivery, traffic operations analysis, and local assistance services in the County of Santa Clara utilizing materials, funds, resources, and services of both organizations.
(d) “Work programs” are the documents prepared jointly by the department and the authority on an annual basis for the three areas of project delivery, traffic operations analysis, and local assistance services that define the tasks to be performed, the job descriptions of the department liaisons located at the authority’s headquarters office in the City of San Jose, and the resources to be provided by the department and the authority to implement the master agreement.

 The department’s District 4 director shall have the authority to direct existing District 4 resources to the demonstration program, and may authorize department staff to perform reimbursed work for projects on and off the state highway system within the boundaries of the County of Santa Clara pursuant to the master agreement and accompanying work programs.

SECTION 1.

It is the intent of the Legislature to enact legislation that would facilitate the implementation of the master agreement executed by the Department of Transportation and the Santa Clara Valley Transportation Authority for the Innovative Delivery Team Demonstration Program in order to improve project delivery, traffic operations analysis, and local assistance services in the County of Santa Clara.
