An act to add Section 4721 to the Civil Code, relating to common interest developments.

AB 1760, as introduced, Frazier. Parking: emergency vehicles.
Existing law, the Davis-Stirling Common Interest Development Act, defines and regulates common interest developments. Existing law includes provisions that limit the authority of the managing association of a common interest development, or the governing documents, as defined, to regulate the use of a member’s separate interest.
This bill would make a prohibition or restriction in the governing documents relating to parking, including, but not limited to, onstreet parking, void and unenforceable with respect to an emergency vehicle owned or under the control of a member.

The people of the State of California do enact as follows:


SECTION 1.

 Section 4721 is added to the Civil Code, to read:

4721.
 (a)  A prohibition or restriction in the governing documents relating to parking, including, but not limited to, onstreet parking, shall be void and unenforceable with respect to an emergency vehicle owned or under the control of a member.
(b) The following definitions apply for purposes of this section:
(1) “Emergency vehicle” means a vehicle described in Section 165 of the Vehicle Code.
(2) “Governing documents” include, but are not limited to, the conditions, covenants, and restrictions of the common interest development, and the bylaws, rules, and regulations of the association.
