An act to add Section 11361.2 to the Health and Safety Code, relating to cannabis.

AB 1733, as introduced, Lackey. Cannabis transportation: enforcement: Department of the California Highway Patrol.
Existing law establishes the Department of the California Highway Patrol to enforce all laws regulating the operation of vehicles and the use of the highways. Existing law makes it a crime to transport, import into the state, sell, furnish, administer, or give away, or offer to transport, import into the state, sell, furnish, administer, or give away, or attempt to import into the state or transport cannabis, except as otherwise provided by law. Existing law also prohibits using a minor to transport cannabis or driving while under the influence of cannabis.
This bill would make the California Highway Patrol the lead agency for the enforcement of offenses involving the transportation of cannabis across local jurisdictions and offenses involving interstate commerce.

The people of the State of California do enact as follows:


SECTION 1.

 Section 11361.2 is added to the Health and Safety Code, to read:

11361.2.
 (a) The Department of the California Highway Patrol shall be the lead agency for the enforcement of offenses involving the transportation of cannabis across local jurisdictions and offenses involving interstate commerce, including, but not limited to, violations of Sections 11360 and 11361 of this code and Section 23152 of the Vehicle Code.
(b) The Department of the California Highway Patrol may collaborate with local law enforcement agencies and relevant state agencies in carrying out this section.
