An act to add Chapter 5 (commencing with Section 1410) to Part 4 of Division 2 of the Labor Code, relating to employment.

AB 513, as amended, Bigelow. Employment: telecommuting employees.
Existing law regulates the wages, hours, and working conditions of any worker employed in any occupation, trade, or industry, whether compensation is measured by time, piece, or otherwise, except as specified.
This bill would authorize an employee working from home or a remote location not at the physical location of the employer to receive legally required notices and postings electronically and sign or acknowledge certain documents electronically. The bill would also require that a working from home employee’s wages due at the time of separation of employment be deemed to have been paid on the date that the wages are mailed to the employee. The bill would also authorize an employee who works from home or a remote location to have any wages due at the time of separation of employment mailed to the employee using the address the employer has on file for the employee for sending notices. The bill would require the wages to be deemed paid on the date of mailing.

The people of the State of California do enact as follows:


SECTION 1.

 Chapter 5 (commencing with Section 1410) is added to Part 4 of Division 2 of the Labor Code, to read:
CHAPTER  5. Telecommuting Employees

1410.
 (a) (1) An employee who works from home and or a remote location that is not at the physical location of the employer may receive all required notices and postings under this code electronically.
(2) Any employee in this category who does not have the ability to receive electronic notices and postings may be given that notice by mail.
(b) An employee who works from home and or a remote location that is not at the physical location of the employer may utilize an electronic signature or electronic acknowledgment for any employment-related documents that require acknowledgment of receipt or attestation.
(c) An employee who works from home’s home or a remote location that is not at the physical location of the employer may have any wages due at the time of separation of employment shall be deemed to have been paid on the date that the wages are mailed to the employee. mailed to the employee using the address the employer has on file for the employee for sending notices. Those wages shall be deemed to have been paid on the date of mailing.
