An act to amend Section 23378.2 23356.6 of the Business and Professions Code, relating to alcoholic beverages.

AB 2627, as amended, Mayes. Alcoholic beverages. beverages: wine blenders.
Existing law, the Alcoholic Beverage Control Act, which is administered by the Department of Alcoholic Beverage Control, regulates the application, issuance, and suspension of alcoholic beverage licenses. Existing law creates the winegrower license and defines a “winegrower” as a person who has facilities and equipment for the conversion of grapes, berries, or other fruit into wine and is engaged in the production of wine. Existing law applies provisions of the Alcoholic Beverage Control Act that pertain to winegrowers, or to the directors, officers, agents, and employees of winegrowers, to wine blenders, and to the directors, officers, agents, and employees of wine blenders, except as otherwise provided under the act.
This bill would remove the agents of wine blenders from the above-described general application of winegrower provisions in the Alcoholic Beverage Control Act to wineblenders.

Existing law, the Alcoholic Beverage Control Act, establishes the Department of Alcoholic Beverage Control for the regulation and licensure of activities related to alcoholic beverages. Existing law authorizes a licensed wholesaler or importer to be issued and hold retail package off-sale beer and wine licenses if the wholesaler or importer sells wine and no other alcoholic beverages at or from the retail premises.

This bill would make a nonsubstantive change to these provisions.

The people of the State of California do enact as follows:


SECTION 1.

 Section 23356.6 of the Business and Professions Code is amended to read:

23356.6.
 Except as otherwise provided in this act, all provisions in this division pertaining to winegrowers, or to directors, officers, agents and employees of winegrowers, shall apply to wine blenders and to directors, officers, agents and employees of wine blenders.

SECTION 1.Section 23378.2 of the Business and Professions Code is amended to read:
23378.2.

Notwithstanding any other provision of this division, a licensed wholesaler or licensed importer may be issued and may hold retail package off-sale beer and wine licenses if the wholesaler or importer sells wine and no other alcoholic beverages at or from the retail premises.
