An act to add Section 716 18980 to the Military and Veterans Government Code, relating to veterans.

Existing law establishes the Department of Veterans Affairs, which, among other things, is required to aid veterans in accessing benefits. Existing law requires the department to develop a transition assistance program for veterans who have been discharged from the Armed Forces of the United States or the National Guard of any state, including higher education benefits and program information, vocational training assistance, and small business resources and information. Existing law, the State Civil Service Act, prescribes a comprehensive civil service
personnel system for the state and specifically provides certain preferences for veterans. Existing law requires a state agency to rank a veteran, widow or widower of a veteran, or spouse of a 100% disabled veteran in the top rank of an eligibility list for hiring when the person achieves a passing score on the examination.

Other existing law authorizes various state entities to require fingerprint images and associated information from a prospective employee whose duties would include access to confidential information and cash, among other things. Existing law generally requires a
state entity that is required to conduct criminal background checks to comply with applicable federal requirements.
This bill would amend veterans’ preference provisions to require the department Department of Human Resources to collaborate with specified state entities to establish a veterans’ preference to be applied to employment opportunities within the field of cybersecurity that require a security clearance. background check. The bill would require a state agency, as defined,
that hires for a position in cybersecurity that requires a security clearance background check to apply the veterans’ preference and to establish a uniform hiring policy for veterans who have held a security clearance in the last year and have left the military in good standing or were honorably discharged. The bill would request the Regents of the University of California to enact for the University of California veterans’ preference provisions that are equivalent to the veterans’ preference provisions added by the bill.

The people of the State of California do enact as follows:
SECTION 1.Section 716 is added to the Military and Veterans Code, to read:716.SECTION 1.
Section 18980 is added to the Government Code, to read:18980.
(a) It is the intent of the Legislature to authorize state departments and agencies that require security clearances background checks to recognize the security clearances held by veterans transitioning from the military in order to remove barriers to employment and accelerate transition to civilian employment within cybersecurity.(b) The department shall collaborate with the Department of Human Resources, Veterans Affairs, the Office of Emergency Services, the Department of Technology, the Department of the California Highway Patrol, and the Military Department to establish a veterans’ preference to be applied to employment opportunities within the field of cybersecurity that require a security clearance. background check.
(c) A state agency, including a public college or university,
agency
that hires for a position in cybersecurity that requires a security clearance background check shall apply the veterans’ preference established in subdivision (b) and shall establish a uniform hiring policy for veterans who have held a security
clearance in the last year and have left the military in good standing or were honorably discharged.
(d) For the purposes of this section, “state agency” means any state office, officer, department, division, bureau, board, commission, or agency of the state. state, including the California State University.
SEC. 2.
The Regents of the University of California are requested to enact for the University of California veterans’ preference provisions that are equivalent to those veterans’ preference provisions in Section 18980 of the Government Code, as added by this act.
