An act to amend Section 3093 of the Business and Professions Code, relating to healing arts.

AB 443, as introduced, Salas. Healing arts: optometry: required examination: notice.
The Optometry Practice Act provides for the licensure and regulation of the practice of optometry by the State Board of Optometry, which is within the Department of Consumer Affairs. That act authorizes the board, before it sets aside the revocation or suspension of an optometrist license, to require the applicant to pass the regular examination given to applicants for an optometrist license.
This bill would require the board, if it exercises its authority to require an applicant to take the regular examination, to notify the applicant of the timeframe to take and pass the examination and to provide the applicant with a minimum 30 days’ notice before an available examination that the applicant is required to take the examination.

The people of the State of California do enact as follows:


SECTION 1.

 Section 3093 of the Business and Professions Code is amended to read:

3093.
 (a) Before setting aside the revocation or suspension of any optometrist license, the board may require the applicant to pass the regular examination given for to applicants for an optometrist license.
(b) If the board requires an applicant to pass the regular examination pursuant to subdivision (a), the board shall do both of the following:
(1) Notify the applicant of the timeframe to take and pass the examination.
(2) Provide the applicant with a minimum 30 days’ notice before an available examination that the applicant is required to take the examination.
