An act to add Article 3 (commencing with Section 89060) to Chapter 1 of Part 55 of Division 8 of Title 3 of, and to repeal Section 89060 of, the Education Code, relating to postsecondary education, and making an appropriation therefor.

SB 65, Cedillo. Public postsecondary education: San Jose State University-National Hispanic University Collaboration.
Existing law establishes the various segments of the public higher education system in the state. These segments include the University of California, which is administered by the Regents of the University of California, the California State University, which is administered by the Trustees of the California State University, and the California Community Colleges, which is administered by the Board of Governors of the California Community Colleges.
This bill would, until December 31, 2008, require the Trustees of the California State University to authorize San Jose State University and the National Hispanic University to enter into a collaboration agreement that would include outreach, transfer, joint classes for credit, and other programs of education, research, and public service as the trustees and the National Hispanic University deem to be in the public interest. The bill would require the Chancellor of the California State University to contract with an independent entity for an evaluation of the program. The bill would require the chancellor to submit copies of this evaluation to the Chairperson of the Assembly Committee on Higher Education and to the Chairperson of the Senate Committee on Education no later than June 30, 2009. The bill would appropriate $3,000,000 from the General Fund to the Chancellor of the California State University to carry out these provisions.

The people of the State of California do enact as follows:


SECTION 1.

 The Legislature finds and declares all of the following:
(a) Programs of outreach to assist disadvantaged and deserving students in their efforts to enter college and complete a baccalaureate degree should be encouraged.
(b) The office of the Chancellor of the California State University has displayed great commitment to outreach by collaborating with, and visiting, local community-based organizations, churches, and other local communities.
(c) Most students in the California State University are transfer students from the community college system and some private institutions.
(d) The National Hispanic University in San Jose, California, provides a valuable service to the people of the state by operating programs for the education of students by providing education and training and by organizing activities relating to education services delivery and research, all of which serve to enhance education and access to education services for residents of Santa Clara County and the entire state.
(e) San Jose State University and the National Hispanic University desire to collaborate to establish joint programs and a transfer program.
(f) A collaboration between San Jose State University and the National Hispanic University is necessary in order for the National Hispanic University program to continue to carry out and to expand its beneficial activities, and this support would be best carried out in conjunction with the office of the Chancellor of the California State University.

SEC. 2.

 Article 3 (commencing with Section 89060) is added to Chapter 1 of Part 55 of Division 8 of Title 3 of the Education Code, to read:

 (a) The trustees shall authorize San Jose State University and the National Hispanic University to enter into a collaboration agreement to include outreach, transfer, joint classes for credit, and other programs of education, research, and public service as the trustees and the National Hispanic University deem to be in the public interest.
(b) This section shall remain in effect only until December 31, 2008, and as of that date is repealed, unless a later enacted statute, that is enacted before December 31, 2008, deletes or extends that date.

 The Chancellor of the California State University shall contract with an independent entity for an evaluation of the program established by this article. The chancellor shall submit copies of this evaluation to the Chairperson of the Assembly Committee on Higher Education and to the Chairperson of the Senate Committee on Education no later than June 30, 2009.

 San Jose State University and the National Hispanic University shall make maximum feasible use of nonstate and nonuniversity funds in carrying out the purposes of this article.

SEC. 3.

 The sum of three million dollars ($3,000,000) is hereby appropriated from the General Fund to the office of the Chancellor of the California State University to carry out the requirements of Article 3 (commencing with Section 89060) of Chapter 1 of Part 55 of Division 8 of Title 3 of the Education Code.
