An act relating to state property.


LEGISLATIVE COUNSEL'S DIGEST


SB 1408, as amended, Harman. State property: City of Laguna Beach.
Existing law generally provides for the use and disposition of state property.
This bill would require any sale of certain state property located in the City of Laguna Beach to be at a price based on its highest and best use,. The bill would also prohibit revised the City of Laguna Beach, if the state transfers its ownership of the property, from revising the zoning of ordinances otherwise applicable to the area that includes that property until a specified event, and void any rezoning of that area in the year 2007 for an unspecified number of years from the date of the transfer, to designate a use for the property that is different from the use for the adjacent nonstate parcels. The bill states that due to specified unique circumstances, a general statute cannot be made applicable within the meaning of Section 16 of Article IV of the California Constitution.

The people of the State of California do enact as follows:


SECTION 1.

 (a) If the state sells a parcel of property consisting of approximately 24,000 square feet located on the west side of State Highway Route 133, also known as Laguna Canyon Road, between Forest Avenue and 0.2 miles north of Canyon Acres Drive in the City of Laguna Beach, referred to as the Laguna Beach State Property, the price shall be based on its the highest and best use of the Laguna Beach State Property.

(b)The City of Laguna Beach shall not revise the zoning ordinances otherwise applicable to the area that includes any parcel of the Laguna Beach State Property unless and until the state transfers its ownership interest in all parcels of the Laguna Beach State Property.

(c)Any action taken by the City of Laguna Beach to rezone the area that includes any parcel of the Laguna Beach State Property during the year 2007 is void, and the only zoning applicable to such an area is the zoning in effect on December 31, 2006.

(d)For purposes of this act, “Laguna Beach State Property” means any parcel of real property owned by the state that is (1) located within the city limits of Laguna Beach, and (2) adjacent to State Highway Route 133, also known as Laguna Canyon Road.

(b) If the state transfers its ownership interest in the Laguna Beach State Property, the City of Laguna Beach shall not, for ____ years from the date of the transfer, revise the zoning ordinances applicable to the area that includes the Laguna Beach State Property to designate a use for it that differs from the use for the nonstate parcels that are adjacent to the Laguna Beach State Property.

SEC. 2.

 Due to the unique circumstances concerning the value and safe use of parcels of the Laguna Beach State Property and the welfare of pedestrians near State Highway Route 133, also known as Laguna Canyon Road, the Legislature finds and declares that a general statute cannot be made applicable within the meaning of Section 16 of Article IV of the California Constitution.
