An act to add Section 52611 to the Education Code, relating to education finance.

SB 1442, Ducheny. Education finance: Joint Commission on Adult Education.
Existing law authorizes the governing boards of high school districts and unified school districts to establish classes or schools for adults. Existing law also establishes standards for the funding of adult education through apportionments based on calculations related to the average daily attendance in adult education classes of a school district.
Existing law establishes the California Community Colleges under the administration of the Board of Governors of the California Community Colleges. Existing law authorizes the establishment of community college districts under the administration of community college governing boards, and authorizes these districts to provide instruction at community college campuses throughout the state. Existing law establishes a system for the apportionment of state funding to community college districts. Existing law specifies various noncredit courses that are eligible for funding from these state apportionments.
This bill would establish the Joint Commission on Adult Education for the purpose of making recommendations regarding the coordination of adult education and noncredit community college programs in order to improve adult education services. The joint commission would advise the Legislature, the Governor, and state agencies regarding program standards, program accountability, quality, and the need for coordination of program services.
The joint commission would be composed of the members of the Board of Governors of the California Community Colleges and the State Board of Education, or their respective designees, 5 members representing the secondary school segment and appointed by the Superintendent of Public Instruction, 5 members representing the community college noncredit segment and appointed by the Chancellor of the California Community Colleges, and, serving ex officio, the Director of Finance, the Legislative Analyst, and the Secretary for Education, or their designees.
The bill would require the joint commission to issue an interim report relating to adult education funding by November 30, 2005, and a final report with its findings and recommendations regarding the coordination of adult education and noncredit community college programs by November 1, 2006. The bill would require the Superintendent of Public Instruction and the Chancellor of the California Community Colleges to provide staff support and other appropriate resources for the joint commission.

The people of the State of California do enact as follows:


SECTION 1.

 Section 52611 is added to the Education Code, to read:

52611.
 (a) The Joint Commission on Adult Education is hereby established for the purpose of making recommendations regarding the coordination of adult education and noncredit community college programs throughout the state in order to enhance the returns on the state’s investment in adult education and to improve adult education services. The joint commission shall advise the Legislature, the Governor, and state agencies regarding program standards, program accountability, quality, and the need for coordination of program services. The commission shall also make recommendations on adequate funding for credit and noncredit courses offered by community colleges and school districts.
(b) The joint commission shall be composed of all of the following:
(1) Each of the members of the Board of Governors of the California Community Colleges and the State Board of Education, or their respective designees.
(2) Ten members who are representatives of district governing boards, school administrators, instructors, and professional associations from either the secondary school segment or the noncredit community college segment. The Superintendent of Public Instruction shall appoint the five members who represent the secondary school segment, and the Chancellor of the California Community Colleges shall appoint the five members who represent the noncredit community college segment.
(3) All of the following shall be ex officio members of the joint commission:
(A) The Director of Finance, or his or her designee.
(B) The Legislative Analyst, or his or her designee.
(C) The Secretary for Education, or his or her designee.
(c) For each fiscal year, the members of the joint commission shall elect one of the members appointed under paragraph (2) of subdivision (b) to act as chairperson of the joint commission. Each fiscal year, the position of chairperson shall alternate between the segments represented pursuant to paragraph (2) of subdivision (b).
(d) The joint commission shall solicit advice from a variety of sources, including, but not necessarily limited to, representatives of community-based organizations that provide literacy education and from representatives of the business community, the Workforce Investment Board, the Employment Development Department, and representatives of the University of California and the California State University providing extension programs.
(e) The joint commission shall issue an interim report relating to adult education funding to the Governor and the chairpersons of the appropriate policy committees of the Legislature by November 30, 2005. The joint commission shall report its findings and recommendations regarding the coordination of adult education and noncredit community college programs to the Governor and the chairpersons of the appropriate policy committees of the Legislature by November 1, 2006.
(f) The Superintendent of Public Instruction and the Chancellor of the California Community Colleges shall provide staff support and other appropriate resources for the joint commission. It is the intent of the Legislature that the joint commission be funded within existing resources.
