An act to amend Section 60651 of the Revenue and Taxation Code, relating to air quality.

AB 2526, as introduced, Oropeza. Carl Moyer Memorial Air Quality Standards Attainment Program: diesel fuel tax money.
The Carl Moyer Memorial Air Quality Standards Attainment Program provides grants to offset the incremental cost of projects that reduce emissions of NOx from covered sources in California. The Carl Moyer Memorial Air Quality Standards Attainment Trust Fund is established to make money in the fund available for purposes of the program upon appropriation by the Legislature. The Diesel Fuel Tax Law imposes a tax upon diesel fuel and requires the money derived therefrom, with a specified exception, to be deposited in the State Treasury to the credit of the Motor Vehicle Fuel Account in the Transportation Tax Fund.
This bill would require a portion of the money derived from the diesel fuel tax to be deposited into the Carl Moyer Memorial Air Quality Standards Attainment Trust Fund, as provided.

The people of the State of California do enact as follows:


SECTION 1.

 Section 60651 of the Revenue and Taxation Code is amended to read:

60651.
 (a) The board shall transmit all money received by it under this part, except the amounts of overpayment of the fees required by Section 60185,
as follows:
(1) An amount equal to one-quarter of one cent ($0.0025) per gallon of diesel fuel sold, into the Carl Moyer Memorial Air Quality Standards Attainment Trust Fund, for the purposes of Chapter 9 (commencing with Section 44275) of Part 5 of the Health and Safety Code.
(2) All remaining money to the Treasurer to be deposited in the State Treasury to the credit of the Motor Vehicle Fuel Account in the Transportation Tax Fund. The
(b) The board shall at the same time furnish copies of the schedules covering the transmittals to the Controller.
