An act to add Section 290.15 to the Penal Code, relating to sex offenders.

AB 181, as amended, Shirley Horton. Sex offender registration.
Existing law requires certain persons convicted of any specified sexual offense to register with local law enforcement officials, as specified.
This bill would require the Department of Justice on or before July 1, 2004, and every year thereafter, to compile and deliver a report to the Legislature detailing certain information, as specified, concerning compliance with provisions requiring sex offenders to register with local law enforcement officials.
This bill would also state legislative findings and declarations concerning the current estimated rate of compliance with provisions which require persons convicted of sexual offenses to register with law enforcement.

The people of the State of California do enact as follows:


SECTION 1.

 The Legislature finds and declares that one of the primary functions of government is to ensure the safety of its citizens. The current estimated rate of compliance with provisions which that require persons convicted of sexual offenses to register with law enforcement is unacceptable. The resulting inability of law enforcement to keep sexual offenders under surveillance and to locate offenders in the course of an investigation constitutes an immediate threat to vulnerable members of our society and to public safety generally.

SEC. 2.

 Section 290.15 is added to the Penal Code, to read:

290.15.
 On or before July 1, 2004, and every year thereafter, the Department of Justice shall compile and deliver a report to the Legislature detailing each of the following with regard to persons described in paragraph (2) of subdivision (a) of Section 290:
(a) The total number of persons who have registered as sex offenders, pursuant to Section 290, at least one time.
(b) The total number of persons who are deceased, incarcerated, or residing out of state.
(c) The number of persons who will be required to register as sex offenders, pursuant to Section 290, in the reporting year.
(d) The number of persons who have registered as sex offenders, pursuant to Section 290, in the prior reporting year.
(e) The number of persons who failed to meet their obligation to register as sex offenders pursuant to Section 290 in the prior reporting year.
(f) The number of persons who, upon release, discharge, parole, probation, or conditional release were required to register pursuant to Section 290 in the prior reporting year, but failed to do so.
(g) An estimate of the total rate of compliance with the provisions of Section 290.
