An act to add Section 1347.5 to the Health and Safety Code, relating to health care service plans.

AB 1161, as introduced, Maldonado. Health care service plans.
Existing law, the Knox-Keene Health Care Service Plan Act of 1975, provides for the regulation and licensing of health care service plans by the Department of Managed Health Care.
This bill would require the department to maintain a comprehensive and accurate list of each health care service plan that operates in the state and the counties in which the health care service plan operates. The bill would require the department to report to the Legislature annually, commencing January 1, 2005, regarding any changes in the counties in which a health care service plan operates. The bill would also require the department to notify a county when a health care service plan withdraws operations from the county.

The people of the State of California do enact as follows:


SECTION 1.

 Section 1347.5 is added to the Health and Safety Code, to read:

1347.5.
 (a) The department shall maintain a comprehensive and accurate list of each health care service plan that operates in the state and the counties in which the health care service plan operates.
(b) (1) The department shall report annually to the Legislature regarding any changes in the counties in which each health care service plan operates. The first report to the Legislature shall be submitted on or before January 1, 2005.
(2) The department shall notify a county when a health care service plan withdraws operations from the county.
