SJR 28, as amended, Knight. Highway construction and expansion: safety.
This measure would memorialize the Congress of the United States to adopt a categorical exemption from federal statutes that require prerequisite studies prior to the expansion of a current highway or construction of a new highway relating to highway and local street and road construction or expansion programs, when the need for the expansion or new construction is safety.
Fiscal Committee: YES  

WHEREAS, Construction and expansion of highways is and local streets and roads are often vital to promoting highway safety; and
WHEREAS, There are portions of highways and local streets and roads in California that are particularly dangerous and pose a significant threat to drivers and passengers; and
WHEREAS, The state has an overriding public interest in protecting the safety of those persons using the California highway system and its local streets and roads; and
WHEREAS, One of the largest roadblocks to expanding current highways and local streets and roads or constructing new highways and local streets and roads to mitigate the danger of particular sections of the highway system their dangers are federal statutes governing the prerequisite studies that must be done prior to a relating to highway construction or expansion program programs; and
WHEREAS, The federal government does not have a categorical exemption from these statutes when safety is an extenuating circumstance; and
WHEREAS, A categorical exemption for safety would allow construction and expansion projects to be completed in an expedited fashion; and
WHEREAS, An expedited process will save countless lives on dangerous sections of highway and local streets or roads; now, therefore, be it
Resolved by the Senate and Assembly of the State of California, jointly, That the Legislature hereby respectfully memorializes the Congress of the United States to enact legislation to amend those federal statutes that require prerequisite studies prior to the expansion of current highways or the construction of new highways, federal statutes relating to highway and local street and road construction or expansion programs to include a categorical exemption from those studies statutes when the need for the expansion or new construction is safety; and be it further
Resolved, That the Secretary of the Senate transmit copies of this resolution to President of the United States, the Speaker of the House of Representatives, and to each Senator and Representative from California in the Congress of the United States.
