February 14, 2001

An act to add Section 42238.5.1 to the Education Code, relating to school finance.

LEGISLATIVE COUNSEL'S DIGEST

AB 250, as introduced, Strom-Martin. School finance.
Under existing law, a school district’s fiscal year average daily attendance is based on the 2nd principal apportionment regular average daily attendance for either the current or prior fiscal year, whichever is greater.
This bill would require, for each fiscal year in which a school district’s average daily attendance is less than the preceding fiscal year’s average daily attendance, and the district’s base revenue limit per unit of average daily attendance is less than the statewide average for its size and type, the county superintendent of schools of the county with jurisdiction over the school district to compute an adjustment to increase the district’s base revenue limit per unit of average daily attendance to the statewide average base revenue limit per unit of average daily attendance for districts of the same size and type. The bill would require the adjustment to be incorporated into the district’s base revenue limit per unit of average daily attendance for the current and subsequent fiscal years.
Vote: MAJORITY   Appropriation: NO   Fiscal Committee: YES   Local Program: NO

The people of the State of California do enact as follows:

SECTION 1.

Section 42238.5.1 is added to the Education Code, to read:

This adjustment shall be incorporated into the school district’s base revenue limit per unit of average daily attendance for the current and subsequent fiscal years.
(b) This section shall not apply to basic aid districts.
