An act to add Section 3502.1 to the Government Code, relating to public employees.

AB 1184, Oropeza. Local public employees.
The existing Meyers-Milias-Brown Act, which governs local public employer-employee relations, establishes the right of local public employees to form, join, and participate in the activities of employee organizations of their own choosing for the purpose of representation on all matters of employer-employee relations.
This bill would expressly prohibit punitive action, denial of promotion, and threats of this treatment against a local public employee for the exercise of any lawful action as an elected, appointed, or recognized representative of any employee bargaining unit.

The people of the State of California do enact as follows:


SECTION 1.

 Section 3502.1 is added to the Government Code, to read:

3502.1.
 No public employee shall be subject to punitive action or denied promotion, or threatened with any such treatment, for the exercise of lawful action as an elected, appointed, or recognized representative of any employee bargaining unit.

SEC. 2.

 The Legislature finds and declares that the provisions of this act are declaratory of existing law.
