An act to add Section 17070.41 to the Education Code, relating to school facilities, and making an appropriation therefor.

AB 2181, as introduced, Maldonado. School facilities funding.
Existing law, the Leroy F. Greene School Facilities Act of 1998, establishes a program for allocation by the State Allocation Board of state per-pupil funding to school districts for new construction and modernization of school facilities, including hardship funding, and supplemental funding for site development and acquisition.
This bill would appropriate, without regard to fiscal years, $600,000,000 from the General Fund to the board for the purposes of the 1998 Greene Act, and would declare the intent of the Legislature to provide similar annual appropriations.
The funds appropriated pursuant to this bill would be applied toward the minimum funding requirements for school districts and community college districts imposed by Section 8 of Article XVI of the California Constitution.

The people of the State of California do enact as follows:


SECTION 1.

 Section 17070.41 is added to the Education Code, to read:

17070.41.
 (a) The sum of six hundred million dollars ($600,000,000) is, notwithstanding Section 13340 of the Government Code, hereby appropriated, without regard to fiscal years, from the General Fund to the State Allocation Board for deposit into the 1998 State School Facilities Fund for the purposes of providing additional funds for new construction and modernization projects, including, but not limited to, hardship applications, pursuant to this chapter as follows:
(1) Of the amount appropriated pursuant to this subdivision, the sum of three hundred million dollars ($300,000,000) shall be allocated for new construction projects, including, but not limited to, new construction hardship applications.
(2) Of the amount appropriated pursuant to this subdivision, the sum of three hundred million dollars ($300,000,000) shall be allocated for modernization projects, including, but not limited to, modernization hardship applications.
(b) The appropriation made pursuant to this section is a one-time appropriation, made in the fiscal year 2000–01 for allocation, without regard to fiscal years, for the purposes of this chapter. However, it is the intent of the Legislature to annually provide subsequent similar appropriations of equal or greater amounts for the purposes of this chapter.
