Relative to unfunded federal mandates.

AJR 38, Pringle. Unfunded federal mandates.
This measure memorializes the President and the Congress of the United States to support federal legislation which would ensure that the federal government would pay the total amount of direct costs incurred by state and local governments in complying with requirements imposed under future federal statutes or regulations.

WHEREAS, For decades, the federal government has passed laws requiring state and local governments to implement innumerable regulations and provide a multitude of services; and
WHEREAS, Local governments provide a variety of necessary public services, but are required to operate giving precedence to federal requirements; and
WHEREAS, These laws have forced state and local governments, in essence, to be financially responsible for federal policies over which they have no control and have undermined the ability of state and local governments to achieve their responsibilities under state and local law; and
WHEREAS, These laws or mandates, in many instances, have added to growing deficits in state and local budgets and have resulted in the need for state and local governments to identify additional, and increase existing, revenue streams or to curtail fire, police, and public safety functions among other services deemed appropriate for their jurisdictions by state and local governments; and
WHEREAS, At a time when California faces a struggling economy, shrinking tax base, and concomitant budgetary shortfalls, there exists a need for greater flexibility in terms of resource expenditure and program prioritization as well as decreasing the financial burden imposed upon state and local governments by unfunded federal mandates; now, therefore, be it
Resolved by the Assembly and Senate of the State of California, jointly, That the Legislature of the State of California respectfully memorializes the President and the Congress of the United States to support and enact United States House of Representatives Bill 140, a measure that will end the practice of imposing unfunded federal mandates on state and local governments and to ensure that the federal government pays the direct costs incurred by state and local governments in complying with requirements imposed under future federal statutes and regulations; and be it further
Resolved, That the Chief Clerk of the Assembly transmit copies of this resolution to the President and Vice President of the United States, to the Speaker of the House of Representatives, and to each Senator and Representative from California in the Congress of the United States.
