An act to add Section 76101.5 to the Government Code, relating to courts, and declaring the urgency thereof, to take effect immediately.

AB 2819, Knight. Courthouse Construction Fund.
Existing law authorizes the board of supervisors of a county to establish a Courthouse Construction Fund and a Criminal Justice Facilities Construction Fund.
This bill would additionally authorize the board of supervisors of a county of the 1st class to provide, by resolution, for the transfer of deposits from one fund to the other. The bill would declare that it would take effect immediately as an urgency statute.

The people of the State of California do enact as follows:


SECTION 1.

 Section 76101.5 is added to the Government Code, to read:

76101.5.
 Notwithstanding any other provision of this article or Article 3 (commencing with Section 76200), following a public hearing, the board of supervisors of a county of the first class which has established both a Courthouse Construction Fund and a Criminal Justice Facilities Construction Fund pursuant to the provisions of this chapter may by resolution provide for the transfer of deposits from one fund to the other.

SEC. 2.

 This act is an urgency measure necessary for the immediate preservation of the public peace, health, or safety within the meaning of Article IV of the Constitution and shall go into immediate effect. The facts constituting the necessity are:
There is an unprecedented fiscal crisis in the funding of municipal, superior, and justice courts and criminal justice facilities and the furniture, fixtures, and equipment necessary to place the courts and criminal justice facilities into operation. Revenues for the funding of court and criminal justice facilities funding have been less than anticipated due to the economic recession, the inability of traffic and parking law violators to pay penalty assessments, and the use by the courts of alternatives to monetary penalties. This act will provide counties of the first class which have established courthouse and criminal justice facilities construction funds needed authority to transfer moneys from one such fund to another, as needed to meet obligations in construction projects, to acquire fixtures, furniture, equipment, and other items necessary to put buildings to use in a timely manner, and to use those transfers to take advantage of opportunities to achieve overall cost savings.
