An act to add and repeal Section 740.7 of the Public Utilities Code, relating to public utilities.

AB 2072, Knight. Public utilities: enterprise zones: military bases.
Existing law permits the Public Utilities Commission to provide incentives for the benefit of industries or business entities located within the boundaries of enterprise zones or economic incentive areas in accordance with specified provisions of law.
The bill would permit the commission to allow public utilities to provide utility service at whatever discounted rate is available in enterprise zones to facilities, as defined, that are located on federal military bases that are scheduled to be closed.
The provisions of the bill would be repealed on January 1, 1999.

The people of the State of California do enact as follows:


SECTION 1.

 Section 740.7 is added to the Public Utilities Code, to read:

740.7.
 (a)  The commission may allow public utilities to provide utility service at whatever discounted rate is presently available in enterprise zones, to facilities located on all federal military bases that are scheduled to be closed.
(b)  For purposes of this section, “facilities” means businesses that the commission determines will continue in existence after closure of the military base, or continuing or new businesses that will engage in transition activities as described in a reuse plan adopted by the appropriate local jurisdiction.

(c)

 This section shall remain in effect only until January 1, 1999, and as of that date is repealed, unless a later enacted statute, which is enacted before January 1, 1999, deletes or extends that date.
