CHAPTER 1217

An act to add Chapter 4 (commencing with Section 13080) to Part 1 of Division 12 of, and to repeal Sections 13080 and 13082 of, the Health and Safety Code, relating to firefighters.

AB 3198, Areias. Firefighters’ Memorial Task Force.
(1)  Existing law provides for the construction of a peace officer’s memorial on the grounds of the State Capitol, as defined.
This bill would require the California Fire Foundation, under the recommendation of the Chair of the Assembly General Research Committee on Fire, Police, Emergency, and Disaster Services and the Chair of the Senate Committee on Rules, to create the Firefighters’ Memorial Task Force, which would remain in effect only until January 1, 1994, and provide for its duties. The bill would authorize construction of a memorial to California firefighters on the State Capitol grounds, as defined, and would direct the California Fire Foundation to provide for its design, construction, and dedication, in consultation with the task force and the State Office of Historic Preservation, and in consultation with, and with the approval of, the Department of General Services and the Historic State Capitol Commission. The site for the memorial would be selected by the task force after consultation with the State Office of Historic Preservation, and after consultation with, and approval of, the Department of General Services and the Historic State Capitol Commission.
This bill would limit the overall size of the memorial to not more than 1/2 of the overall size of the California Vietnam Veterans’ Memorial located on the grounds of the State Capitol.
(2)  The bill also would provide for the conduct of firefighters’ memorial ceremonies by the California Fire Foundation, in consultation with the Assembly General Research Committee on Fire, Police, Emergency, and Disaster Services.
This bill would provide that certain of its provisions shall remain in effect only until January 1, 1994.

The people of the State of California do enact as follows:


SECTION 1.

 Chapter 4 (commencing with Section 13080) is added to Part 1 of Division 12 of the Health and Safety Code, to read:
CHAPTER  4. Firefighters' Memorial

13080.
 (a)  The California Fire Foundation is the fundraising entity for the Firefighters’ Memorial. The California Fire Foundation, under the recommendations of the Chair of the Assembly General Research Committee on Fire, Police, Emergency, and Disaster Services, and the Chair of the Senate Committee on Rules, shall create a Firefighters’ Memorial Task Force, hereafter referred to as the task force, of seven members. The California Fire Foundation shall appoint a minimum of one nominee submitted by the California Professional Firefighters, California Fire Chiefs Association, California Fire Districts Association, California State Firefighters’ Association, and the California Department of Forestry Employees Association.
(b)  The members of the task force shall receive no compensation or reimbursement for expenses.
(c)  This section shall remain in effect only until January 1, 1994, and as of that date is repealed, unless a later enacted statute, that is chaptered before January 1, 1994, deletes or extends that date.

 (a)  The construction of a memorial to California firefighters on the grounds of the State Capitol is hereby authorized. For purposes of this chapter, the grounds of the State Capitol is that property in the City of Sacramento bounded by Ninth, Fifteenth, “L,” and “N” Streets. The actual site for the memorial shall be selected by the task force after consultation with the State Office of Historic Preservation, and after consultation with, and approval of, the Department of General Services and the Historic State Capitol Commission.
(b)  No state moneys shall be expended for any of the purposes specified in this chapter. Funds for the construction of the memorial shall be provided exclusively through private contributions for this purpose.

13082.
 (a)  With respect to the design, construction, and dedication of the memorial, the California Fire Foundation shall, in consultation with the task force, do all of the following:
(1)  Establish a schedule for the design, construction, and dedication of the memorial.
(2)  Implement procedures to solicit designs for the memorial and devise a selection process for the choice of the final design.
(3)  Select individuals or organizations to provide fundraising services and to construct the memorial.
(4)  Review and monitor the design and construction of the memorial and establish a program for the dedication of the memorial.
(5)  Report to the Legislature through the Assembly General Research Committee on Fire, Police, Emergency, and Disaster Services on the progress of the memorial.
(6)  Limit the overall size of the memorial to not more than one-half of the overall size of the California Vietnam Veterans Memorial located on the grounds of the State Capitol.
(7)  Consult with the State Office of Historic Preservation, and consult with, and obtain the approval of, the Department of General Services, and the Historic State Capitol Commission.
(b)  This section shall remain in effect only until January 1, 1994, and as of that date is repealed, unless a later enacted statute, which is chaptered before January 1, 1994, deletes or extends that date.

13083.
 Firefighters’ memorial ceremonies, including the dedication of the memorial and any subsequent ceremonies, shall be conducted by the California Fire Foundation, in consultation with the Assembly General Research Committee on Fire, Police, Emergency, and Disaster Services.
