An act to add Section 17921.2 to the Health and Safety Code, relating to land use.

AB 69, as amended, Ting. Land use: accessory dwelling units.
Existing law requires the Department of Housing and Community Development to propose building standards to the California Building Standards Commission, and to adopt, amend, or repeal rules and regulations governing, among other things, apartment houses and dwellings, as specified.
This bill would require the department to propose small home building standards governing accessory dwelling units smaller than 800 square feet, junior accessory dwelling units, and detached dwelling units smaller than 800 square feet, as specified, and to submit the small home building standards to the California Building Standards Commission for adoption on or before January 1, 2021.

The people of the State of California do enact as follows:


SECTION 1.

 Section 17921.2 is added to the Health and Safety Code, to read:

17921.2.
 (a) Except as provided in subdivision (b) of Section 17921, the department shall propose for adoption small home building standards.
(b) The small home building standards shall include standards for accessory dwelling units of less than 800 square feet and junior accessory dwelling units that include allowances for small kitchens and bathrooms with small appliances.
(c) The small home building standards shall be drafted to achieve the most cost-effective construction standards possible. The small home building standards applicable to detached accessory dwelling units and other detached dwelling units less than 800 square feet shall be similar or more cost effective than standards in the 2007 edition of the California Building Standards Code. shall also take health and safety into consideration.
(d) The small home building standards shall be submitted to the California Building Standards Commission for adoption on or before January 1, 2021.
(e) For purposes of this section, “small home” means an accessory dwelling unit less than 800 square feet, a junior accessory dwelling unit, and any other detached dwelling unit less than 800 square feet.
