4. Modernization Projects
81845.
Modernization projects funded pursuant to this article shall address improvements to extend the useful life of, or to enhance the physical environment of, a community college campus.81845.1.
Each community college district that desires to receive funds for modernization projects under this chapter shall submit an application to the Board of Governors of the California Community Colleges.81845.2.
A community college district shall be eligible to receive funds for the modernization of permanent school buildings that are more than 25 years old and portable classrooms that are more than 20 years old, and that have not been previously modernized with state funding.81845.3.
(a) Costs that may be funded under this article include, but are not limited to, the costs of design, testing, inspection, plan checking, construction management, demolition, construction, replacement of portable facilities, utility costs, furniture and equipment, telecommunications equipment, wiring for technology, fire safety, abatement of hazardous materials, and seismic safety. The costs of site acquisition and routine maintenance and repairs may not be funded pursuant to this article.(b) The Board of Governors of the California Community Colleges shall provide no more than 80 percent of the funding of, and the participating community college district shall provide at least 20 percent of the funding of, a modernization project funded pursuant to this article.
81845.4.
The board of governors shall adopt regulations that specify the number of full-time equivalent students that can be housed in each teaching station.81845.5.
(a) The board of governors shall determine the total funding eligibility of a community college district for modernization funding by multiplying three thousand one hundred ten dollars ($3,110) by the number of full-time equivalent students housed in permanent school buildings that are more than 25 years old or in portable classrooms that are more than 20 years old, and that have not been previously modernized with state funding.(b) The board of governors shall annually adjust the factors set forth in subdivision (a) according to the adjustment for inflation set forth in the statewide cost index for class B construction, as determined by the board.
81845.6.
(a) The board of governors shall release funds to community college districts with approved applications for modernization, to the extent that state general obligation bond funds are available to fund 80 percent of the project and if the community college district has provided the 20 percent local matching funds as required by paragraph (2) of subdivision (b).(b) Subject to the availability of funds, the board of governors shall allocate funds to an eligible community college district only upon the occurrence of both of the following events:
(1) The approval of the project by the Department of General Services pursuant to the Field Act, as defined in Section 17281.
(2) The certification by the community college district that the required 20 percent matching funds from local sources have been expended by the district for the project, and that the district has entered into a binding contract for the completion of the project.
(c) If funds from state general obligation bond proceeds are insufficient to fund all qualifying community college districts under this article, the board of governors shall, in accordance with the calculations made under Section 81845.5, determine which projects have the highest priority for the receipt of available funds.
81845.7.
Funding for the purpose of implementing this article shall be appropriated in the annual Budget Act from general obligation bond proceeds approved by the voters after January 1, 2000.
