An act to amend the Budget Act of 2022 (Chapters 43, 45, and 249 of the Statutes of 2022) by amending Items 6100-149-0890 and 6100-197-0890 of Section 2.00 of that act, and to amend the Budget Act of 2023 (Chapters 12 and 38 of the Statutes of 2023) by amending Items 0540-492, 3360-491, 4140-490, 6100-149-0890, 6100-197-0890, and 7350-001-0001 of Section 2.00 of, and adding Items 3360-002-0890, 3360-003-0890, 3360-004-0890, and 3360-102-0890 to Section 2.00 of, and amending Section 39.00 of, that act, relating to the state budget, and making an appropriation therefor, to take effect immediately, budget bill.

SB105, Skinner . Budget Acts of 2022 and 2023.
The Budget Act of 2022 and the Budget Act of 2023 made appropriations for the support of state government for the 2022–23 and 2023–24 fiscal years.
This bill would amend the Budget Act of 2022 and the Budget Act of 2023 by amending and adding items of appropriation and making other changes.
This bill would declare that it is to take effect immediately as a Budget Bill.

SECTION 1.

 Item 6100-149-0890 of Section 2.00 of the Budget Act of 2022 is amended to read:
6100-149-0890—For local assistance, State Department of Education, American Rescue Plan Act for After School and Child Care Programs, payable from the Federal Trust Fund ........................

Provisions:
1. Of the funds appropriated in Schedule (1), $30,710,000, is provided to expand access to summer learning programs and constitutes the state’s reserve of funds for summer enrichment programs, for the purposes of Section 2001(f)(2) of the federal American Rescue Plan Act of 2021 (P.L. 117-2).
2. Of the funds appropriated in Schedule (2), $3,293,906,000 is provided for transfer to the State Department of Social Services.

SEC. 2.

 Item 6100-197-0890 of Section 2.00 of the Budget Act of 2022 is amended to read:

1.
For the 2022–23 fiscal year, the daily per pupil funding provided to local educational agencies participating in the 21st Century Community Learning Centers Program shall be $10.18.
2. Of the funds appropriated in this item, $3,000,000 in one-time federal carryover funds is available to support the existing program.
3. Of the funds appropriated in this item, $32,583,000 in one-time federal carryover funds is available to expand access to summer learning programs and constitutes the state’s reserve of funds for summer enrichment programs for the purposes of Section 2001(f)(2) of the federal American Rescue Plan Act of 2021 (P.L. 117-2).
4. Of the funds appropriated in Schedule (1), $3,000,000 shall be available for Save the Children to operate after school education and safety programs in rural school districts for the purposes of Section 2001(f)(3) of the federal American Rescue Plan Act of 2021 (P.L. 117-2).

SEC. 3.

 Item 0540-492 of Section 2.00 of the Budget Act of 2023, as amended by Senate Bill 104 of the 2023-24 Regular Session, is amended to read:
0540-492—Reappropriation, Secretary of the Natural Resources Agency. The balances of the appropriations provided in the following citations are reappropriated for the purposes provided for in those appropriations and shall be available for encumbrance or expenditure until June 30, 2026:

SEC. 9.

 Item 4140-490 of Section 2.00 of the Budget Act of 2023, as added by Senate Bill 104 of the 2023-24 Regular Session, is amended to read:
4140-490— Reappropriation, Department of Health Care Access and Information. The amounts specified in the following citations are reappropriated for the purposes provided for in those reappropriations and shall be available for encumbrance or expenditure until June 30, 2028:
0001—General Fund
(1) Up to $13,975,000 in Item 4140-001-0001, Budget Act of 2022 (Chs. 43, 45, and 249, Stats. 2022)
(2) Item 4140-101-0001, Budget Act of 2022 (Chs. 43, 45, and 249, Stats. 2022). Up to $2,000,000 in Program 3840-Facilities Development may be used by the department for the original purpose and may be used, if necessary, to address emerging health concerns in reproductive health care. The department may move funds to Program 3831-Health Care Quality and Affordability if this option is exercised.

The State Department of Education shall prioritize the allocation of the resources identified in this provision to support after school safety and enrichment for teens programs or a one-time rate increase for these programs. The State Department of Education shall notify the Joint Legislative Budget Committee and the Department of Finance upon distribution of these funds.

 Item 7350-001-0001 of Section 2.00 of the Budget Act of 2023 is amended to read:

1.
Of the amount appropriated in Schedule (4), $20,000,000 shall be used to support the California Youth Apprenticeship Program for encumbrance or expenditure until June 30, 2025. It is the intent of the Legislature that $25,000,000 will be provided in the 2024–25 fiscal year to support this program.
2.
Of the funds appropriated in Schedule (4), $15,000,000 shall be used to support the Women in Construction Priority Unit established at the Department of Industrial Relations pursuant to Section 107.7.1 of the Labor Code.
4.
Of the amount appropriated in Schedule (4), $40,000,000 shall be available for the Apprenticeship Innovation Funding program. These funds shall be available for encumbrance or expenditure until June 30, 2025.

SEC. 13.

 Section 39.00 of the Budget Act of 2023, as amended by Senate Bill 104 of the 2023-24 Regular Session, is amended to read:

SEC. 14.

 This act is a Budget Bill within the meaning of subdivision (e) of Section 12 of Article IV of the California Constitution and shall take effect immediately.
