An act to amend Section 377.31 of the Code of Civil Procedure, relating to civil actions.

SB 251, as introduced, Borgeas. Civil actions: Effect of death.
Existing law allows, after the death of a person who commenced an action or proceeding, the decedent’s personal representative or, if none, the decedent’s successor in interest to continue a pending action or proceeding that does not abate, as specified.
This bill would make a technical, nonsubstantive change to that provision.

The people of the State of California do enact as follows:


SECTION 1.

 Section 377.31 of the Code of Civil Procedure is amended to read:

377.31.
 On motion motion, after the death of a person who commenced an action or proceeding, the court shall allow a pending action or proceeding that does not abate to be continued by the decedent’s personal representative or, if none, by the decedent’s successor in interest.
