Amended  IN  Senate  April 16, 2007

CALIFORNIA LEGISLATURE— 2007–2008 REGULAR SESSION

Senate Bill
No. 71

Introduced  by  Senator Florez

January 17, 2007

An act to add Section 43867.1 to the Health and Safety Code, relating to air pollution.

LEGISLATIVE COUNSEL'S DIGEST

SB 71, as amended, Florez. Alternative fuels: biodiesel.
Existing law requires the State Energy Resources Conservation and Development Commission, in partnership with the State Air Resources Board, to develop and adopt a state plan to increase the use of alternative fuels, as defined.
This bill would require all vehicles owned or leased by the State of California, by a city, county, or city and county, or by a mass transit district, that use diesel fuel to instead use B20 biodiesel fuel or a higher blend of biodiesel, as specified if biodiesel blend fuel is cost-competitive and readily available. The bill would require the State Air Resources Board to establish a program to implement and monitor these requirements.
Because this bill would establish additional requirements on vehicles owned or leased by cities, counties, and mass transit districts, it would impose a state-mandated local program.
The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.
This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions.
Vote: MAJORITY   Appropriation: NO   Fiscal Committee: YES   Local Program: YES

The people of the State of California do enact as follows:

SECTION 1.

Section 43867.1 is added to the Health and Safety Code, to read:

43867.1.
 (a) All vehicles owned or leased by the State of California, by a city, county, or city and county, or by a mass transit district, that use diesel fuel shall instead use B20 biodiesel fuel or a higher blend of biodiesel, if biodiesel blend fuel is cost-competitive and readily available .
(b) If a blend of biodiesel is used pursuant to subdivision (a), instead of B20 biodiesel fuel, that fuel shall contain at least 20 percent nonpetroleum constituents.
(c) The State Air Resources Board state board shall establish a program that implements and monitors the requirements of this section.

SEC. 2.

If the Commission on State Mandates determines that this act contains costs mandated by the state, reimbursement to local agencies and school districts for those costs shall be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of the Government Code.
