An act to amend Section 1569.172 of the Health and Safety Code, relating to residential care facilities.

SB 461, as introduced, Wright. Residential care facilities: fingerprinting: cost.
Existing law, the California Residential Care Facilities for the Elderly Act, provides for the licensure and regulation of residential care facilities for the elderly by the State Department of Social Services.
Existing law requires various individuals involved in providing services to the elderly in residential care facilities to submit fingerprints to the department and, for purposes of searching the records of the Federal Bureau of Investigation, to the Department of Justice. Existing law requires the Department of Justice, within 14 days of the receipt of the fingerprints, to notify the department of the criminal record information regarding the individual or the lack thereof, and permits the Department of Justice to charge a fee sufficient to cover its cost in providing services to the department in connection with the criminal record information.
This bill would specify that the department may charge a fee sufficient to cover its reasonable cost in providing the above services.

The people of the State of California do enact as follows:


SECTION 1.

 Section 1569.172 of the Health and Safety Code is amended to read:

1569.172.
 The Department of Justice may charge a fee sufficient to cover its reasonable cost in providing services in accordance with Section 1569.17 to comply with the 14-day requirement for provision to the department of the criminal record information, as contained in subdivision (c) of Section 1569.17.
