An act to add Section 66025.3 to the Education Code, relating to public postsecondary education, making an appropriation therefor, and declaring the urgency thereof, to take effect immediately.

SB 1450, as amended, McPherson. Public postsecondary education: fees: summer terms or sessions.
Existing law provides for a public postsecondary education system in this state. This system consists of the University of California, the California State University, and the California Community Colleges. Existing law provides for systemwide fees for resident undergraduate students at these institutions.
This bill would require that the systemwide fees charged to matriculated students at the University of California and the California State University for instruction during summer terms or sessions not exceed the any fees charged to matriculated students for equivalent instruction during other academic terms or sessions. The bill would appropriate $24,000,000 from the General Fund to the Controller for allocation, in accordance with a prescribed schedule, to the University of California and the California State University for the 2000-01 fiscal year as a reimbursement for fiscal losses of the respective universities resulting from any fee reduction required by the bill. The bill would only apply to the University of California to the extent that the Regents of the University of California, by appropriate resolution, make the bill applicable.
The bill would become operative on July 1, 2000, or on the date on which it is chaptered, whichever occurs last.
The bill would declare that it is to take effect immediately as an urgency statute.

The people of the State of California do enact as follows:


SECTION 1.

 Section 66025.3 is added to the Education Code, to read:

66025.3.
 Systemwide fees charged to matriculated students at the University of California and the California State University for instruction during summer terms or sessions shall not exceed the any fees charged to matriculated students for equivalent instruction during other academic terms or sessions.

SEC. 2.

 The sum of twenty-four million dollars ($24,000,000) is hereby appropriated from the General Fund to the Controller for allocation as follows:
(a) Twelve million dollars ($12,000,000) to the University of California for the 2000-01 fiscal year for the purpose of reimbursing the university for fiscal losses resulting from any fee reduction required by Section 66025.3 of the Education Code, as added by Section 1 of this act. This allocation is contingent upon the implementation of the fee reduction by the Regents of the University of California.
(b) Twelve million dollars ($12,000,000) to the California State University for the 2000-01 fiscal year for fiscal losses resulting from any fee reduction required by Section 66025.3 of the Education Code, as added by Section 1 of this act.

SEC. 3.

 This act shall become operative on July 1, 2000, or on the date on which it is chaptered, whichever occurs last.

SEC. 4.

 This act is an urgency statute necessary for the immediate preservation of the public peace, health, or safety within the meaning of Article IV of the Constitution and shall go into immediate effect. The facts constituting the necessity are:
So that the fee adjustments enacted by this bill may be in effect for the beginning of the 2000–01 academic year, it is necessary that this act take effect immediately.
