LEGISLATIVE COUNSEL'S DIGEST

SB 1283, Polanco. Community college facilities: modernization projects.
Existing law establishes the California Community Colleges under the administration of the Board of Governors of the California Community Colleges. Existing law authorizes the establishment of community college districts under the administration of community college governing boards, and authorizes these districts to provide instruction at community college campuses throughout the state. Under the existing Community College Construction Act of 1980, the Board of Governors of the California Community Colleges assembles statewide data on facility and construction costs, formulates cost standards and construction standards, and is authorized to allocate funds for community college construction upon their appropriation by the Legislature. Under the act, the governing boards of community college districts prepare and submit to the Board of Governors of the California Community Colleges plans for capital construction in their respective districts.
This bill would authorize the Board of Governors of the California Community Colleges to allocate, upon appropriation by the Legislature, funds for modernization projects, as defined to include improvements to extend the useful life of, or to enhance the physical environment of, a community college campus. The bill would specify the types of costs that would be funded under the bill. The bill would require that the Board of Governors of the California Community Colleges would provide no more than 80% of the funding of, and the participating community college district would provide at least 20% of the funding of, a modernization project funded under the bill. The bill would set forth calculations to determine the amount of funding of projects under the bill.
The bill would require that funding for the purpose of the bill be appropriated in the annual Budget Act from general obligation bond proceeds approved by the voters after January 1, 2000.

The people of the State of California do enact as follows:

SECTION 1.

Article 4 (commencing with Section 81845) is added to Chapter 4 of Part 49 of the Education Code, to read:

81845.2.
A community college district shall be eligible to receive funds for the modernization of permanent school buildings that are more than 25 years old and portable classrooms that are more than 20 years old, and that have not been previously modernized with state funding.

81845.3.
 (a) Costs that may be funded under this article include, but are not limited to, the costs of design, testing, inspection, plan checking, construction management, demolition, construction, replacement of portable facilities, utility costs, furniture and equipment, telecommunications equipment, wiring for technology, fire safety, abatement of hazardous materials, and seismic safety. The costs of site acquisition and routine maintenance and repairs may not be funded pursuant to this article.

(2) The certification by the community college district that the required 20 percent matching funds from local sources have been expended by the district for the project, and that the district has entered into a binding contract for the completion of the project.
