A resolution to propose to the people of the State of California an amendment to the Constitution of the State, by adding Section 33 to Article I thereof, relating to the right to food.

SCA 10, as introduced, Hurtado. Right to food.
The California Constitution enumerates various personal rights, including the right to enjoy and defend life and liberty, acquiring, possessing, and protecting property, and pursuing and obtaining safety, happiness, and privacy.
This measure would declare that the fundamental human right to healthy food access exists in this state. The measure would declare that it is the shared obligation of state and local jurisdictions to respect, protect, and fulfill this right.

Resolved by the Senate, the Assembly concurring, That the Legislature of the State of California at its 2023–24 Regular Session commencing on the fifth day of December 2022, two-thirds of the membership of each house concurring, hereby proposes to the people of the State of California, that the Constitution of the State be amended as follows:

 That Section 33 is added to Article I thereof, to read:

SEC. 33.
 The State hereby recognizes the fundamental human right to healthy food access for everyone in this state. It is the shared obligation of state and local jurisdictions to respect, protect, and fulfill this right.
