An act to add Chapter 22.9 (commencing with Section 22685) to Division 8 of the Business and Professions Code, relating to social media platforms.

AB 2461, as amended, Mathis. User authentication.
Existing law generally regulates social media platforms, including by requiring a social media platform that operates in the state to create, and publicly post on the social media platform’s internet website, a policy statement that includes, among other things, the social media platform’s policy on the use of the social media platform to illegally distribute a controlled substance. The California Consumer Privacy Act of 2018 grants to a consumer various rights with respect to personal information that is collected by a business, as defined, including the right to request that a business delete personal information about the consumer that the business has collected from the consumer.
This bill would require a social media platform to, on or before January 1, 2026, develop and make publicly available on its internet website a voluntary, optional identification verification mechanism that allows a user to provide a valid state identification for the purpose of verifying the user’s identity. The bill would also require a social media platform to denote on the profile of an authenticated user that the user’s identity has been verified. that authenticates the identity of a user to delete any personal information submitted by the user to the social media platform for that purpose within 30 days of the date upon which the social media platform authenticates the user’s identity.

The people of the State of California do enact as follows:


SECTION 1.

 Chapter 22.9 (commencing with Section 22685) is added to Division 8 of the Business and Professions Code, to read:
CHAPTER  22.9. Social Media User Authentication

 As used in this chapter:

(a)“Authenticated user” means a user whose identity has been verified pursuant to the mechanism created by the social media platform pursuant to Section 22686.

(b)

(a) “Social media platform” has the same meaning as defined in Section 22945.

(c)

(b) “User” means a natural person who is a resident of the state and has an active account with a social media platform.

(a)On or before January 1, 2026, a social media platform shall develop and make publicly available on its internet website a voluntary, optional identification verification mechanism that allows a user to provide a valid state identification for the purpose of verifying the user’s identity.

(b)(1)A social media platform shall denote on the profile of an authenticated user that the user’s identity has been verified.

(2)A social media platform may comply with this subdivision through means of a graphic, including a check mark.

 A social media platform that authenticates the identity of a user shall delete any personal information submitted by the user to the social media platform for that purpose within 30 days of the date upon which the social media platform authenticates the user’s identity.
