An act to add and repeal Section 711 of the Public Utilities Code, relating to energy.

Energy: small modular reactors: feasibility study.
Existing law vests the Public Utilities Commission (PUC) with regulatory authority over electrical corporations. Existing law prohibits the State Energy Resources Conservation and Development Commission from certifying a nuclear fission thermal powerplant, except for specified powerplants, and provides that a nuclear fission thermal powerplant, except those specified powerplants, is not a permitted land use in California, unless certain conditions are met regarding the existence of technology for the construction and operation of nuclear fuel rod processing plants and of demonstrated technology or means for the disposal of high-level nuclear waste, as specified.
This bill would require the PUC, in collaboration with the Independent System Operator,
PUC to conduct a feasibility study on the impact of permitting the building of use of small modular reactors, as defined, for energy generation in the state, including an evaluation including, among other things, an evaluation of the minimum feasible
capacity and quantity of small modular reactors necessary to achieve reliability, ratepayer, employment, and decarbonization benefits. benefits of small modular reactors in comparison with other renewable resources used, or planned for use, in the state. The bill would require the PUC to submit a report on the results of the feasibility study to the Legislature on or before January 1, 2027.

The people of the State of California do enact as follows:
SECTION 1.
Section 711 is added to the Public Utilities Code, to read:711.
(a) The commission, in collaboration with the Independent System Operator, commission shall conduct a feasibility study on the impact of permitting the building of small modular reactors in the state. The study shall include, but not be limited to, an evaluation of the minimum feasible capacity and quantity of small modular reactors necessary to achieve reliability, ratepayer, employment, and decarbonization benefits.

The study shall include, among other things, an evaluation of the benefits of small modular reactors in comparison with other renewable resources used, or planned for use, in the state. The benefits evaluated shall include, but are not limited to, impacts on reliability, affordability, employment, decarbonization, socioeconomics, environmental justice, and public safety. The study shall also include an evaluation of solutions for spent fuel from small modular reactors.(b) The commission shall submit a report on the results of the feasibility study to the Legislature on or before January 1, 2027.
(c) For purposes of this section, “small modular reactor” means a nuclear reactor with an electrical generating capacity of up to 300
megawatts per unit.
(d) (1) A report to be submitted pursuant to subdivision (b) shall be submitted in compliance with Section 9795 of the Government Code.
(2) Pursuant to Section 10231.5 of the Government Code, this section is repealed on January 1, 2028. 2031.
